PREAMBULE
BE ATEX places great importance on protecting the Personal Data of its customers, website users, partners and employees.
This Charter lays down the commitments of BE ATEX with regard to protection of the personal data of web users who visit this website (www.be-atex.com) and users of the GREG tracking software (management and reporting of gas equipment). It may be modified at any time by BE ATEX, to take account of new developments, in particular in order to ensure compliance with all regulatory, legal, editorial and/or technical changes.
Before browsing the website, we recommend that you consult the latest version of the Charter available on the website.
The Charter shall apply as a supplement to the provisions laid down in the General Terms and Conditions of Use and the General Terms and Conditions of Sale.

2 - HOW IS YOUR DATA COLLECTED AND PROCESSED ?
In France, personal data is protected primarily by French Data Protection Act no. 78-87 of 6 January 1978, French law no. 2004-801 of 6 August 2004, article L. 226-13 of the French Penal Code, and the European Directive of 24 October 1995.

In any event, Mr Grégory Tasca – the website owner – only collects personal data related to users for the requirements of certain services offered by the website www.be-atex.com. 3 – WHO RECEIVES YOUR PERSONAL DATA ?
Your data is processed by BE ATEX. Said data may be sent to third parties that have a contract with BE ATEX for the purpose of performing the essential tasks required to manage your orders, your account and your payments.
The data provided is not used by these third-party service providers for their own purposes.
4 – HOW LONG IS YOUR PERSONAL DATA RETAINED ?
The Personal Data retention period varies depending on the end purpose of the data collected. Unless otherwise specified by law, BE ATEX retains Personal Data for the time required to carry out the intended purpose.
The data is retained for the time required to process it (request for a catalogue, information, quote or work on the equipment) and for a maximum period of 13 months for statistics-related data obtained via cookies except for anonymisation or in the case of a legal obligation to retain certain data for a longer period.
5 – WHAT SECURITY MEASURES ARE IN PLACE ?
BE ATEX uses an HTTPS protocol, a secure hypertext transfer protocol, for its website. This protocol guarantees the integrity and confidentiality of your data when it is exchanged between your terminal and the website. This protocol covers the entire website, meaning that your browsing experience is 100% secure.
We continue to apply physical and electronic security measures for the collection, retention, storage and communication of the personal information related to our customers.
You must take measures to protect yourself against any unauthorised use of your password and device. If you share a computer, you should sign out after every use. If you discover a breach in your data security, please let us know immediately.
Because Personal Data is confidential, BE ATEX restricts access to said data to its own employees and service providers which require access for processing purposes. All the people who have access to Personal Data are bound by a duty to ensure said data is treated as confidential, and may be subject to disciplinary meausres and/or other penalties if they fail to comply with theses obligations.
6 – WHAT ARE YOUR RIGHTS AND HOW CAN YOU EXERCISE THEM ?
Subject to the limits laid down in the regulations in force, you have several rights with regard to the processing of your Personal Data:
- The right to be informed about the use of your Personal Data;
- The right to consult the personal information we have obtained about you;
- The right to request rectification of any Personal Data that is inaccurate, incomplete, wrong or out of date;
- The right to ask BE ATEX to erase your Personal Data or stop processing it in certain circumstances;
- The right to withdraw your agreement to receive information from us, and the right to object to the processing of your data (especially when said processing is for the purpose of sending promotional or marketing messages);
- The right to request that we return your data to you or transfer it to another service provider (i.e. right to data portability);
- The right to give instructions about the fate of your Personal Data after your death;

If you wish to exercise one of your rights, your request must be submitted in writing, be signed and sent to us along with a copy of your signed proof of identity. The request must specify the address to which the reply is to be sent. BE ATEX will have 1 (one) month in which to reply as of the date on which your request is received. This time frame may be extended to two months depending on the complexity and number of requests sent to BE ATEX. In such cases, we will notify you of this extension and explain the reasons why it is justified.

8 – APPLICABLE LAWS AND MODIFICATION OF THE PRIVACY POLICY
DAPPLICABLE LAW AND COURT OF JURISDICTION
Any disagreement concerning use of the website www.be-atex.com is subject to the laws of France.
The exclusive court of jurisdiction shall be the competent courts of Paris.
