Drinking alcohol can be a risk when it is excessive. The consequences of intoxication can be very serious. The company must take steps to control the risks associated with alcohol. The existence of alcohol controls, for example, can limit the dangers. The prevention of addictive behaviors requires the development of a collective prevention approach, combined with individual care. The rules define the rights and obligations of the members of the company. It also identifies the means of control available.

Risks related to addictive behavior must be taken into account in the risk assessment. In addition, these risks must be integrated into the DUERP (Document Unique d'Evaluation des Risques Professionnels) so that appropriate preventive measures can be put in place.

Employers have several legal tools at their disposal to deal with alcohol-related risks. It also has means of control and detection.

Control of alcoholic beverages in the workplace

The Labor Code limits the alcoholic beverages that may be brought into the workplace. Thus, "no alcoholic beverage other than wine, beer, cider and perry is allowed in the workplace. When the consumption of alcoholic beverages (...) is likely to affect the safety and physical and mental health of workers, the employer, pursuant to Article L. 4121-1 of the Labour Code, shall include in the internal regulations or, failing that, by memorandum, measures to protect the health and safety of workers and to prevent any risk of accident. These measures, which may take the form of limiting or even prohibiting such consumption, must be proportionate to the goal sought." (Article R. 4228-20 of the Labor Code).

The rules of procedure

In addition to the DUERP, the internal regulations are a legal tool to support the prevention of alcohol-related risks. However, care must be taken with regard to its content, as this document can only deal with points relating to health, safety and discipline (article L. 1321-1 of the French Labor Code). It may not therefore contain any provisions that infringe on the rights of individuals or on individual and collective freedoms.

Should I say "Alcotest®" or "Ethylotest"?

Often the terms "breathalyzer" and "breathalyzer" are confused. The term breathalyzer refers to the measuring device in general. Regardless of how it works or who makes it, a breathalyzer is simply a device for measuring blood alcohol levels. The term Alcotest® is a registered trademark of the manufacturer Dräger. It therefore only refers to the brand's products.

It is also much more accurate, as it can give you the exact level of alcohol detected.
